Member Services: Terms and Conditions
Terms of Use.
These Terms of Use (“Terms”) govern your access to and use of the [https://wework.co.in/member-services/] available on the WeWork website and mobile application (“Platform”) and the services available through it. The Platform is owned and operated by WeWork India Management Limited (“WeWork”, “we”, “us” or “our”).
By accessing or using the Platform, you (“Member” or “you”) agree to be bound by these Terms, our Privacy Notice, and any service-specific terms presented at the point of selection. If you do not agree, please do not use the Platform. If you are using the Platform on behalf of an organisation, you confirm you are duly authorised to bind that organisation to these Terms.
About the Platform.
The Platform enables WeWork members to discover and access value-added services offered by independent third-party vendors (“Vendors”) and WeWork’s role is limited to listing the Vendors on the Platform and assisting you in connecting with the relevant Vendors, post which the Vendors will reach out to you to schedule a discovery call and discuss packages and pricing.
It is expressly clarified that WeWork’s role is limited to operating the Platform and assisting you in connecting with the relevant Vendors. The underlying services are provided by the relevant Vendors, who are solely responsible for service delivery, quality, and related compliances. WeWork is not the provider, seller, or supplier of any service listed on the Platform.
Services.
The “services” here means the third-party services made available for discovery or access through the Platform, which include inter alia food and beverage, transport, staffing, wellness, learning and development, GCC services, insurance, software solutions, corporate merchandise, and such other services as may be added or removed from the Platform from time to time.
The services are listed on the Platform for your discovery, with the engagement and transaction taking place under separate offline arrangements. In all cases, the Vendor’s own terms and conditions, any separate offline or online agreements and other relevant policies (“Vendor Terms”) will govern the provision of the services. Listings, descriptions, images, and any pricing related information present on the Platform is provided by WeWork to you on behalf of the Vendor. WeWork does not warrant their accuracy, and you should verify details with the Vendor before proceeding.
Role of WeWork.
WeWork does not endorse, guarantee, or warrant the quality, safety, availability, legality, or suitability of any Vendor or service. Any ratings or descriptions displayed on the Platform are provided by WeWork in good faith on behalf of the Vendor and WeWork’s role is limited to making that service listing available and connecting you with the relevant Vendors.
In respect of any insurance-related service, WeWork acts solely as a neutral point of introduction to a licensed insurer or insurance intermediary. WeWork does not recommend, sell, or advise on insurance products, and is not involved in any aspect of the policy or claims process. It is expressly clarified that WeWork does not solicit, negotiate, or sell any insurance product and is not registered as an insurance broker or corporate agent under applicable IRDAI regulations. Any contact between you and an insurer or insurance intermediary facilitated through the Platform is initiated solely at your request.
WeWork may add, modify, suspend, restrict, or remove any Vendor or service from the Platform if it so deems fit in the interest of the Members and the Platform if WeWork reasonably considers such action necessary to protect its Members, business, reputation, or to ensure compliance with Applicable Law.
Eligibility.
The Platform is available only to WeWork members and their authorised personnel who are at least 18 years of age and competent to contract under applicable Indian law. During your use of the Platform, you represent and warrant that you have the authority to bind all your end-users and personnel who will access or use the services on your behalf. Services are intended primarily for business use. You are responsible for keeping your account information accurate and updated and for all activity which takes place under your account without any cost or consequence to WeWork.
Vendor Terms.
Each service is subject to the applicable Vendor Terms, which will be made available to you at or before the point of engagement by the Vendors. By proceeding to use a service, you confirm you have read and accepted the relevant Vendor Terms.
In the event of any conflict between these Terms and the Vendor Terms in respect of the actual delivery of a service, the Vendor Terms will prevail as between you and the Vendor. In the event of any conflict between these Terms and the Vendor Terms in respect of your access to and use of the Platform, these Terms will prevail.
Pricing and Invoicing.
Prices are set by the Vendor for the WeWork Members and published on the Platform. Any invoicing facilitated by WeWork does not make WeWork the provider of the underlying service. The refund, return, cancellation, and related terms in relation to each service will be governed by the Vendor Terms. WeWork does not charge Members for their access to and use of the Platform.
Acceptable Use.
You agree to use the Platform only for lawful purposes and in accordance with these Terms, the Vendor Terms (to the extent applicable), and applicable law. You must not misuse the Platform, introduce harmful code, attempt unauthorised access, scrape or copy Platform content, or resell any service without express permission.
Without limiting the above, you must not use the Platform to host, transmit, publish, or share any content or conduct that: (i) belongs to another person; (ii) is grossly harmful, harassing, blasphemous, defamatory, obscene, pornographic, pedophilic, or libelous; (iii) harms minors; (iv) violates any applicable law; (v) threatens national integrity or security; (vi) impersonates another person; or (vii) contains software viruses or any harmful code.
Grievances.

Complaints about a service may be raised with either Vendor or WeWork in the first instance, at the discretion of the Member. If you are unable to resolve a complaint directly with the Vendor, you may also escalate to WeWork at grievance.memberservices@wework.co.in. Where a grievance is raised with, or escalated to, WeWork will route the matter to the Vendor and may facilitate communication in its capacity as Platform operator, without assuming responsibility for the underlying service.
Intellectual Property.
All rights, title, and interests in the Platform and all WeWork content, trademarks, and brand elements are owned by or licensed to WeWork. You are granted a limited, non-exclusive, non-transferable licence to use the Platform for the purpose of discovering and accessing services. No other rights are granted by virtue of your access to the Platform.
All text, graphics, photographs, trademarks, logos, and artwork available or accessible on the Platform in respect of the services constitute third party content. WeWork does not create, control, or endorse such third-party content, and acts solely as an intermediary in relation thereto, in accordance with, and subject to, its obligation as an intermediary under Applicable Law.
Data and Privacy.
WeWork’s collection and use of your personal data is governed by our Privacy Notice at https://wework.co.in/policies/privacy/.
When you engage with a Vendor through the Platform, relevant details will be shared with that Vendor for the purpose of lead generation and to the extent necessary to facilitate the Service. Where the Vendor independently collects your data directly, the Vendor’s own privacy policy governs such processing.
Disclaimers and Limitation of Liability.
The Platform is provided on an “as is” and “as available” basis. To the extent permitted by applicable law, WeWork disclaims all warranties in relation to the Platform and the services accessible through it.
In no event shall WeWork and our affiliates, parents, and successors and each of our and their employees, assignees, officers, agents and directors (collectively, the “WeWork Parties”) be liable under contract, tort, strict liability, negligence or any other legal or equitable theory with respect to the Platform for any indirect, consequential, incidental, punitive, compensatory or consequential damages of any kind whatsoever (however arising) or special damages, including loss of profits, data, or goodwill, arising from your use of the Platform, even if advised of the possibility of such damages. To the extent permitted by law, the WeWork Parties disclaim all warranties and terms, express or implied, with respect to the Platform, content or services (including third party services) on or accessible through the Platform, including any warranties or terms of merchantability, fitness for a particular purpose, title, non-infringement and any implied warranties, or arising from course of dealing, course of performance or usage in trade.
WeWork is not liable for any deficiency, delay, loss, or damage arising from the performance of a Vendor’s service. The WeWork Parties disclaim all liability to the maximum extent permitted by law, for claims, damages, expenses or any other losses arising out of or in connection with products or services availed through the Vendors or any other third party. Your recourse in respect of a service lies against the relevant Vendor under the Vendor Terms. To the extent permitted by applicable law, WeWork’s aggregate liability under these Terms shall not exceed INR 5000/- (Indian Rupees Five Thousand Only).
The Member acknowledges and agrees that any services finally availed from Vendors are governed by separate and independent agreements. To the maximum extent permitted by applicable law, WeWork shall not be responsible or liable for any acts, omissions, deficiencies, or disputes arising out of or in connection with services availed by the Member from any Vendor. The Member agrees that, in respect of any issue or dispute relating to Vendor services, their primary recourse shall lie solely against the relevant Vendor, and WeWork shall not be joined as a party to any such issue or dispute. Nothing in this clause shall operate to exclude or limit WeWork's liability for: (i) death or personal injury caused by WeWork's negligence; (ii) fraud or fraudulent misrepresentation by WeWork; or (iii) any other liability that cannot be excluded or limited under the Consumer Protection Act, 2019 or any other applicable law.
Indemnity.
You agree to indemnify WeWork against any claims, losses, or costs arising from your breach of these Terms or the Vendor Terms, your violation of applicable law, or your misuse of the Platform.
Suspension and Termination.
WeWork may suspend or terminate your access to the Platform if you breach these Terms, if required by law, or if WeWork considers it necessary to protect the Platform or its users. Termination does not affect accrued obligations.
Governing Law and Disputes.
These Terms are governed by the laws of India. Subject to any separate terms executed between the Member and WeWork, disputes will first be subject to amicable resolution, and thereafter to the exclusive jurisdiction of the courts of Bengaluru, Karnataka. Nothing in this clause limits the rights of a 'consumer' as defined under the Consumer Protection Act, 2019 to approach the appropriate consumer forum in respect of any deficiency in the services.
The courts at Bengaluru, Karnataka shall have exclusive jurisdiction over matters arising under these Terms.
Severability.
If any provision of these Terms is held invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.
Force Majeure.
WeWork shall not be liable for any failure or delay in performing its obligations under these Terms where such failure or delay arises from causes beyond its reasonable control, including but not limited to, war (whether an actual declaration thereof is made or not), sabotage, insurrection, rebellion, riot or other act of civil disobedience, act of a public enemy, failure or delay in transportation, act or action of any Government or any agency or subdivision thereof, including any act or action by way of any statute, or any other act or action whatever judicial action, labor dispute, fire accident, explosion, epidemic, pandemic, lockdowns, quarantine restrictions, or flood, lightning, earthquake or other Act of God (each a “Force Majeure Event”).
Waiver.
No failure or delay by WeWork in exercising any right under these Terms shall operate as a waiver of that right.
Acceptance.
Your access to the Platform is conditional upon your affirmative acceptance of these Terms at the time of registration. By clicking the checkbox, you confirm that you have read, understood, and agree to be bound by these Terms.
Changes to These Terms.
WeWork may update these Terms from time to time. Changes will be posted on the Platform. Your continued use after posting constitutes acceptance of the revised Terms.
